Fatwa: The food that we do not know how they slaughtered
The Principle/
Qaidah:
أن ما غاب عنا
لا نسأل عنه
Meaning: That what we have missed, we do not ask about.
This principle talking about how muslim does not has to ask
about the meat that has been served to us. Such as about how it is slaughtered?
Is it meet the halal requirement?
Is it slashed/ cut in the name of Allah or not? This principle stated that
every meat (that in substance is halal or halal li ‘ainihi) and it was served
by muslim or people of the book automatically become halal for muslim.
This
principle is based on hadith narrated by Bukhari,
عن عائشة -رضي
الله عنها-: أنّ قومًا قالوا: يا رسول الله إنّ قومًا يأتوننا باللحم لا نَدري
أَذَكروا اسمَ الله عليه أم لا، فقال رسول الله -صلى الله عليه وسلم-: «سَمُّوا
الله عليه وكُلُوه».
Aishah (may
Allah be pleased with her) reported: Some people said: "Ya Rasullah, meat
was brought to us by some people, and we are not sure whether the name of Allah
has been mentioned on it or not (at the time of slaughtering the
animals)." Rasulullah peace be upon him said: "Mention the name of
Allah upon it and eat it." (Hadith
by Bukhari)
From this
hadith, scholars said, this hadith is an evident that all what we are doing
basically is right and allowed until there is a proof that said otherwise.
