Conclusion: Halal

Explanation:

Scholars have different opinion regarding this matter. Some disallowed it, and some allowed it. Most of them are forbid it because the fact that Majus belongs to the group of musyrikun (the heathen). This is based on QS al-Maidah: 5

وَطَعَامُ ٱلَّذِينَ أُوتُوا۟ ٱلْكِتَـٰبَ حِلٌّۭ لَّكُمْ وَطَعَامُكُمْ حِلٌّۭ لَّهُمْ

Meaning: “and the food of those who were given the Scripture is lawful for you and your food is lawful for them”.

This verse has the meaning that the food is allowed as long as presented by People of the book, and not others. And there are also many hadith that support this opinion.

While the other said that the food is halal due the hadith narrated by Imam Malik and Imam Syafii stated:

سنوا بهم سنة أهل الكتاب

Meaning: “They follow the same sunna as the people of the Book”

And the second hadits narrated by Imam Bukhari that stated they (Majus) pay the Jizyah and Rasulullah received it. In additional to that, Imam Ibnu Hazm (in Mahally) that they (Majusi) are the People of the book, so judge them as you judge the People of the book in everything.

In the conclusion, Syekh Yusuf al-Qardhawi does not choose either opinion, he just represented it. Even the majority of Ulama forbid it, but there are who allowed it. In this case, we can choose regarding our circumstances. For those who can, it better to take the path of caution and not consume it at all.
